1. Acceptance of Terms
By accessing and using Pixoria, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.
Age Requirement: You must be at least 18 years of age to use Pixoria. By using our service, you represent and warrant that you meet this age requirement.
Account Access: Pixoria may access your account or information associated with your account to provide support, perform maintenance, for security-related reasons, or for any other legitimate business purpose. You acknowledge and consent to such access.
2. Use of Service
Pixoria provides AI-powered image generation and Etsy listing creation services. You agree to:
- Use the service only for lawful purposes
- Not upload illegal, harmful, or copyrighted content
- Not attempt to abuse, exploit, or reverse-engineer our systems
- Not share your account credentials with others
- Respect intellectual property rights
3. Credits and Billing
Our service operates on a credit-based system:
- Paid subscriptions include monthly credit allocations
- Credits are consumed when generating images or listings
- Unused credits do not roll over to the next billing period
- All payments are processed securely through Stripe
- Subscriptions renew automatically unless cancelled
Credit Card Authorization: By providing your credit card information, you authorize Pixoria (or our payment processor Stripe) to charge your credit card for all fees applicable to your subscription plan. You authorize us to continue charging your credit card until you cancel your subscription or these amounts are paid in full. You must provide current, complete, and accurate billing information and promptly update it if your card is lost, stolen, or expires.
Upgrade and Downgrade: If you upgrade your plan, your credit card will be charged a pro-rated amount reflecting the increased rate immediately, and the full new rate will apply to your next billing cycle. If you downgrade your plan, the new rate will apply starting with your next billing cycle. Downgrading may result in loss of features, credits, or account capacity. Pixoria is not liable for any such loss.
4. Intellectual Property
Your Content: You retain all rights to images you upload. By using our service, you grant us a license to process and generate content based on your inputs.
Generated Content: You own the images generated through our service and may use them for commercial purposes. However, AI-generated content may have limitations under copyright law.
License to Your Data: You grant Pixoria a royalty-free, non-exclusive, worldwide license to access and use your data (uploaded images, generated content, usage patterns) for the following purposes: (i) providing and improving our AI services, (ii) analyzing and enhancing service quality, (iii) compiling anonymized aggregate statistics for marketing and research purposes. We will not share your specific data with third parties without your permission. All aggregate data will be anonymized and will not identify you or your content.
4.1. Etsy Integration & Compliance
IMPORTANT DISCLAIMER: The term 'Etsy' is a trademark of Etsy, Inc. This Application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
Our Etsy integration allows you to:
- Generate SEO-optimized listing content (titles, tags, descriptions)
- Connect your Etsy shop via secure OAuth authentication
- Create draft listings directly in your Etsy shop (with your permission)
Your Responsibilities:
- You must ensure your products comply with Etsy's Creativity Standards (handmade, vintage 20+ years, or craft supplies only)
- You are responsible for compliance with all Etsy policies including Prohibited Items Policy and Intellectual Property Policy
- You must review all AI-generated content before publishing to Etsy
- You acknowledge that Pixoria does NOT guarantee Etsy policy compliance
- You will not use Pixoria to create listings for mass-produced or prohibited items
Limitation of Liability:
Pixoria is not responsible for Etsy account suspensions, listing rejections, policy violations, or any consequences arising from your use of the Etsy integration. You acknowledge that Etsy, Inc. and its affiliates are not the application developer, do not provide the application service, and make no warranties with respect to the application or data accessed through it.

5. Refund Policy
Due to the nature of our service (immediate delivery of digital goods), we generally do not offer refunds. However, we may consider refund requests on a case-by-case basis for technical issues or service failures.
6. Service Availability
We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.
7. Limitation of Liability
Pixoria is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the service, including but not limited to lost profits, data loss, or business interruption.
8. Account Termination
Termination by Pixoria: Pixoria may suspend or terminate your access to all or any part of the service at any time, with or without cause, with or without notice, effective immediately. We will notify you via email to your registered email address if we terminate your account.
Termination for Breach: If you materially breach this Agreement, we will provide you with notice and thirty (30) days to cure such breach. If you fail to cure the breach within this period, we may terminate your account. However, we reserve the right to terminate immediately for serious violations including fraud, abuse, illegal activity, or violations of third-party rights.
Termination by You: You may cancel your subscription at any time through your billing settings or by contacting support@pixoria.app. Upon cancellation, your subscription will remain active until the end of your current billing period.
Effect of Termination: Upon termination, your right to use the service will immediately cease. All provisions of this Agreement which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms.
10. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
Any disputes arising out of or related to this Agreement or your use of Pixoria shall be subject to the exclusive jurisdiction of the courts located in Brussels, Belgium. You irrevocably consent to the jurisdiction of such courts.
For US Residents: While Belgian law governs this Agreement, US residents retain all rights under applicable US federal and state consumer protection laws. Nothing in this Agreement limits your statutory rights under US law.
10.1. US-Specific Provisions
California Residents: Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice:
- The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210
- You have the right to file a complaint with the California Attorney General's office
Electronic Signatures: By using Pixoria, you consent to conduct transactions electronically and to receive electronic records, in accordance with the US Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
Arbitration Opt-Out (US Residents): If you are a US resident and do not wish to be bound by arbitration, you may opt out by sending written notice to support@pixoria.app within 30 days of account creation.
